Zas678 he/him Posted March 25, 2011 Posted March 25, 2011 Here's a rundown. Each High School gets together a team of 8 or so students. They assign about half to be witnesses and half to be attorneys. They then get (from the State) Case Materials and Simplified Rules of Evidence (aka the story and the rules). We then come up with a "case": what we thought happened. The witnesses and attorneys decide which points to bring out with each witness, to best present that case. When they feel prepared (hopefully), they go up against another school. One school will be Prosecution (trying to prove the defendent guilty), and the other Defense (trying to prove the defendent innocent). They will be judged, in a courtroom, by real judges and attorneys based on performance and accuracy. It ends up going like this: For the purpose of clarification, we will call prosecution Team A, and defense Team B. Team A Opening Statements: Each team will send up their own attorney, who will spend 5 minutes telling us the case. What really happened, and why the defendent is innocent or guilty, based off of the law. No objections are allowed at this time. Team B Opening Statement: Same as above. Now that Opening Statements are done, they will proceed on to the trial. It always starts with Prosecution. Team A witness 1 Direct: A Direct is a story, written by the attorney and the witness of the same team, based off of the WItness affadavit in the Case Materials. If they try and put stuff in the direct that isn't in the Case Materials, than a Team B attorney will Object, and try to say why what was just said was Creating Material Fact. Team A attorney will attempt to defend themselves, saying that the witness is merely "extrapolating". The judge will then make a ruling either to sustain, (accept the objection), or to overule (ignore) the objection. The direct will go on till the story is told. Once the Direct is told, Crosses are next. Crosses are the dark side of Directs. Team B will prepare the questions, and won't tell the Team A witnesses beforehand what is being asked. Team B will ask Leading Questions (Yes or No), and will try to make the Team A witness look bad, or to bring out a point that strengthens Team B's Case. This ranges to a bias, to faulty computer servers, to having poor eyesight. Team B attorney will be doing most of the talking. After crosses are done, Team A will be allowed a short redirect to try and recover from a cross. This repeats for the next two Team A witnesses before a midtrial break. After the break, it's Team B's turn. They will call up their three witnesses, who will go through the same thing that the Team A witnesses went through. After all witnesses have been crossed, then it is time for the Closings. Team A will go first, then Team B, then Team A is allowed a short rebuttal. The Closing Statements are much like the opening statements. The attorney will say what their team proved, and how, under the law, the defendant is innocent or guilty. After this, the judges give their scores and say good job, and one team walks away with a triumphant victory, and one team walks away disheartened. Note that the scores (win/lose) and the verdict (innocent/guilty) are not always the same. You can win because each of your witnesses played their parts, but end up not making the verdicts because you didn't talk about the law during your closing. But the verdict doesn't really matter. So that's the basics of Mock Trial. Any Questions?

Except we had to start from the crime scene and find our own evidence. I was on the CSI and Prosecution team, so I did a lot of the work. We won (and it was the correct person), despite the investigator team's idiocy in losing a primary piece of evidence. @Chaos. Yeah. My stepfather and I like to wrestle. Last night, he tackled my when I wasn't expecting it and I reflexively threw him into the window. Thankfully, I didn't get in trouble.
